July 16, 2026 marked one year since Roberto Mosquera Del Peral, Kassim Saleh Wasil, Dung Tien Nguyen, Phone Chomsavanh, and Orville Etoria were deported from the United States to Eswatini and detained at Matsapha Correctional Complex. One year later, the secretive third-country removal arrangement has not ended; it has expanded. At least 25 more people have reportedly been removed from the United States to Eswatini under the same arrangement, bringing the total number of people reportedly transferred to at least 30, including 11 people who reportedly arrived on July 8, 2026.

Dear Honorable Minister Prince Simelane,

July 16, 2026 marked one year since Roberto Mosquera Del Peral (who originates from Cuba), Kassim Saleh Wasil (from Yemen), Dung Tien Nguyen (from Vietnam), Phone Chomsavanh (from Laos), and Orville Etoria (from Jamaica) were deported from the United States to Eswatini under a secretive third-country removal arrangement and detained at Matsapha Correctional Complex. One year on, the arrangement has continued and expanded. At least 30 people have now reportedly been transferred from the United States to Eswatini. Two people transferred under the arrangement have since left Eswatini: Orville Etoria was repatriated to Jamaica, and Pheap Rom to Cambodia.

In April 2026, the Eswatini Supreme Court confirmed a High Court order granting lawyers access to people removed by the United States and detained at Matsapha Correctional Complex. Despite these developments, the Eswatini authorities have not publicly clarified who remains detained, the legal basis for their detention, or what safeguards are in place to prevent onward refoulement.

I urge you to provide a full public account of all people transferred from the United States to Eswatini, the legal basis for any detention, and whether any had previously received protection under the Convention against Torture. I also urge you to ensure that every person detained is brought promptly before a competent court to determine the lawfulness of their detention or released immediately if no lawful basis exists. Pending this, I urge you to guarantee confidential access to lawyers, families, consular officials, interpreters, medical care, and independent monitors and prevent any onward transfer to a country where they face a real risk of serious human rights violations.
